Terms of Service

Not approved for production.

This working draft still requires the operator’s legal identity, postal address, jurisdiction, governing law, competent courts, support email, effective date and owner/legal approval. It must not be treated as final legal advice or a production-ready contract.

Terms in brief

  • You must be at least 18 and able to enter into a binding contract.
  • Time&Place is a film-discovery and research aid. Its catalogue may be incomplete or wrong and is not an authoritative professional source.
  • A Registered Free account receives 7 Search and Work credits once. Free credits do not reset or expire.
  • Yearly Unlimited is one tax-inclusive payment of €15 for 365 days. It is not a subscription and does not renew automatically.
  • Personal and individual professional use is allowed. Resale, bulk extraction, scraping, automated access and attempts to bypass limits are prohibited.
  • We do not offer a voluntary refund policy, but your mandatory cancellation, conformity and refund rights always remain available.

This summary is provided for convenience. The complete Terms below are binding and control if the summary and the complete Terms conflict.

1. Who operates Time&Place

Time&Place is operated by [OPERATOR_LEGAL_NAME] (“Time&Place”, “we”, “us” or “our”), with a postal address at [POSTAL_ADDRESS], established in [JURISDICTION].

You can contact us about these Terms, the service or your account at [SUPPORT_EMAIL]. Privacy questions and personal-data requests are handled as described in our Privacy Policy.

2. Acceptance and eligibility

These Terms form a contract between you and the operator when you create a registered account, expressly accept the Terms, purchase Yearly Unlimited, or otherwise use the service after the Terms are presented to you. If you do not agree, do not create an account, purchase access or use Time&Place.

You must be at least 18 years old and have the legal capacity to enter into this contract. If you use Time&Place in connection with your work, you confirm that you are authorised to do so. Accounts remain personal and do not become multi-user or enterprise accounts merely because they are used for work.

3. What Time&Place provides

Time&Place helps users discover films and other works by time, place and related setting information, inspect work details, and maintain private likes and collections. Search results and catalogue entries may combine information from multiple sources and may change as the catalogue is corrected or updated.

The service is an exploratory and research aid. It is not an archival authority, academic citation service, legal, financial, historical or other professional advice. You are responsible for independently checking any information before relying on it in research, publication, professional work or a decision that may affect another person.

4. Accounts and security

You must provide accurate registration information and keep it reasonably current. You are responsible for safeguarding your email account and active sessions, and for activity carried out through your account unless applicable law provides otherwise.

Do not share, sell, transfer or lend an account, use another person’s account without permission, create accounts through automation, or use multiple identities to evade access controls. Tell us promptly at [SUPPORT_EMAIL] if you believe an account or session has been compromised.

5. Registered Free access

Each Registered Free account receives one combined allocation of 7 Search and Work credits. A qualifying Search execution or Work view may consume a credit. Ordinary refinements tied to the same search execution and other actions identified as free in the product do not consume another credit.

Free credits do not reset or expire, have no cash value, cannot be transferred, and are not a stored-value product. While Yearly Unlimited is active, qualifying use does not consume the remaining Free credits; that balance becomes available again after Yearly Unlimited ends. We may use proportionate technical measures to prevent duplicate identities or other attempts to bypass a limit.

6. Yearly Unlimited

Yearly Unlimited costs a final tax-inclusive total of €15 and provides 365 days of access beginning when payment is confirmed and the entitlement is activated. It is a one-time purchase, not a subscription, and it does not renew or charge automatically.

Yearly Unlimited includes unlimited Search and Work access and the paid features described on the pricing surface when you purchase. The material commercial terms of an already paid 365-day period will not be reduced before that period expires, except where a change is required by law, necessary to address security or abuse, or permitted under mandatory consumer law.

7. Promo access

A valid promo code may activate Yearly Unlimited or extend an existing entitlement by 365 days from the later of the current expiry or redemption time. Unless a campaign says otherwise, a campaign may be redeemed once per account and may have an expiry date, an overall redemption limit or other stated conditions.

Promo codes have no cash value. You may not sell, falsify, automatically test, harvest or redeem codes through fraud or technical circumvention. We may reject or reverse an invalid, expired, unauthorised or fraudulently obtained redemption.

8. Payments, cancellation and refunds

Payments are processed by lava.top. We receive payment status and transaction identifiers but do not store complete payment-card details. Before leaving Time&Place for lava.top, you will see the total price, access period, renewal status, links to these Terms and the Privacy Policy, and a separate request for access to begin immediately after payment.

We do not offer a voluntary refund or cooling-off policy beyond rights that apply under mandatory law. This does not limit any statutory right to cancel, obtain a price reduction, require conformity, terminate for non-conformity or receive a refund. Where applicable law permits it, you may be required to pay for the proportion of service supplied after you requested immediate performance and before a valid cancellation.

If a payment is reversed, charged back or found to be unauthorised, we may suspend the related entitlement while the issue is investigated. This does not restrict a good-faith payment dispute or any mandatory remedy.

9. Permitted use

We grant you a limited, non-exclusive, non-transferable and revocable right to use the service for personal use and individual professional research during the applicable access period. You may share ordinary links and limited excerpts where the product permits it and where doing so respects third-party rights.

You must not:

  • resell, sublicense, republish or commercially exploit the service or a substantial part of the catalogue;
  • scrape, crawl, harvest, bulk-download or access the service through bots, scripts or other automation without our written permission;
  • bypass credits, authentication, entitlements, rate limits, access controls or security measures;
  • reverse engineer or interfere with the service except to the limited extent applicable law expressly permits;
  • probe for vulnerabilities, introduce malware, overload infrastructure or disrupt another user;
  • use Time&Place for unlawful, fraudulent, deceptive or rights-infringing activity.

10. Your inputs and private collections

You retain any rights you have in search queries, collection names and other material you provide. You give us a limited, worldwide, non-exclusive licence to host, process, reproduce and technically transform that material only as needed to operate, secure, support and improve the service and comply with law.

Likes and collections are private account features unless Time&Place expressly introduces a separate sharing feature with its own clear controls. You must not enter unlawful material or material that infringes another person’s rights. Our handling of personal data is governed by the Privacy Policy.

11. Intellectual property and third parties

Time&Place, its interface, software, design, branding and original editorial material are owned by or licensed to the operator. These Terms do not transfer those rights to you.

Film titles, descriptions, identifiers, ratings, images, trademarks and other catalogue material may belong to third parties or come from third-party sources. Your use remains subject to any applicable third-party rights. Links to IMDb and other external services are provided for convenience; those services are controlled by their own operators and terms, and we are not responsible for their availability or content.

12. Availability and service changes

We may maintain, correct, secure, update or change Time&Place and its catalogue. Temporary interruptions may occur. We will use reasonable care but do not promise uninterrupted, error-free or permanent availability.

We may make changes that do not materially reduce paid access without additional charge. If a change materially and negatively affects an active paid user, we will provide the notice and remedy required by applicable law. If we discontinue the paid service before an entitlement ends, we will provide any notice, continued access, replacement or refund required by law.

13. Suspension and termination

If we reasonably believe you have breached these Terms, we will normally give notice and a reasonable opportunity to correct the breach. We may restrict or suspend access immediately where necessary to prevent fraud, security harm, unlawful conduct, serious abuse, harm to another person, or violation of a legal requirement.

We may terminate an account for a material or repeated breach that is not corrected after notice. A suspension or termination for your breach does not create a voluntary right to a refund, but it does not remove any mandatory consumer remedy. You may contact [SUPPORT_EMAIL] to contest an action.

14. Account deletion

You may request export or deletion of your account through [SUPPORT_EMAIL]. Deletion ends access to the account, private likes, collections and any remaining entitlement. Before requesting deletion, export anything you are legally entitled and wish to retain.

Account deletion does not create a voluntary refund. We may retain limited records where required for payment, fraud prevention, security, tax, legal claims or another lawful obligation, as explained in the Privacy Policy. Mandatory rights remain unaffected.

15. Disclaimers

To the maximum extent permitted by law, Time&Place is provided “as is” and “as available”. Catalogue data may be incomplete, disputed, outdated or incorrect; settings may be interpretive; and a search result may omit a relevant work. You must independently verify information before relying on it.

We do not make promises that cannot reasonably apply to an evolving discovery service. Nothing in these Terms excludes an express product commitment shown at purchase or a guarantee, warranty or remedy that applicable law does not allow us to exclude.

16. Limits on liability

To the maximum extent permitted by law, our total aggregate liability arising from or relating to Time&Place or these Terms will not exceed the amount you paid to us during the 12 months immediately preceding the event giving rise to the claim.

This limit does not apply to fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence, breach of a non-excludable statutory duty, or any other liability that applicable law does not allow us to exclude or limit. It also does not reduce any mandatory right to a refund, price reduction or other consumer remedy.

17. Mandatory consumer rights

If you use Time&Place as a consumer, you may have mandatory rights under the law of the country where you live, including rights concerning pre-contract information, cancellation, conformity, remedies, unfair terms and access to courts. These Terms do not exclude, restrict or replace those rights.

If a provision of these Terms conflicts with a mandatory consumer protection, the mandatory protection controls only to the extent of the conflict and the remaining Terms continue to apply.

18. Changes to these Terms

We may update these Terms to reflect service changes, clearer wording, legal requirements, security needs or changes in how we operate. We will provide registered users at least 14 days’ advance notice of a material change through the service or their account email.

A change may take effect sooner where required by law or reasonably necessary to address an urgent security, fraud or abuse risk; we will explain the reason where we lawfully can. Material commercial terms for an active paid period remain protected as described in section 6. If a future change requires renewed consent, we will ask for it expressly rather than treating silence as consent.

19. Resolving disputes

Please contact [SUPPORT_EMAIL] first and describe the issue and the resolution you seek. We and you will try in good faith to resolve the dispute informally before starting court proceedings, unless urgent relief is needed or waiting would prejudice a legal right or limitation period.

These Terms do not require mandatory arbitration and do not waive a right to bring a claim in a court that has jurisdiction under applicable law.

20. Governing law and courts

These Terms are governed by [GOVERNING_LAW]. Subject to mandatory consumer rights and applicable rules of jurisdiction, disputes may be brought before [COMPETENT_COURTS].

If you are a consumer, this choice does not deprive you of mandatory protections that would apply under the law of your usual country of residence, and it does not require you to use a court where applicable law gives you the right to proceed elsewhere.

21. General terms and contact

If a provision is found invalid or unenforceable, it will be limited only as much as necessary and the remaining provisions will continue. A delay in enforcing a right is not a waiver. Headings and the brief summary are for convenience.

You may not transfer this contract or an account without our written permission. We may transfer the contract as part of a lawful reorganisation, financing or transfer of the service, provided that doing so does not reduce mandatory consumer rights.

Questions about these Terms should be sent to [SUPPORT_EMAIL] or by post to [OPERATOR_LEGAL_NAME], [POSTAL_ADDRESS]. Effective date: [EFFECTIVE_DATE].
